On an early and snowy December morning, our client, a tractor-trailer driver, was traveling his regular delivery route from Buffalo to Central New York when another tractor-trailer traveling the opposite direction attempted to make an illegal pass in the righthand lane around several passenger vehicles while on a blind turn. The other driver lost control of his truck causing it to jackknife and slide sideways head-on into our client’s truck: severely injuring him. Keith Vona and John Richmond were at the hospital in Syracuse the next morning to meet with the client and his family; and then immediately began collecting and preserving evidence, securing witness statements, and taking all of the necessary steps to ensure the client’s case would be successful moving forward.
The client sustained various injuries including: four fractures to his lower legs: (1) a closed left comminuted pilon fracture, (2) a left tibial tubercle fracture, (3)a left distal fibular metaphysis fracture, (4) a closed right split-depression tibial plateau fracture and right lateral meniscus tear; a Carry periorbital ecchymosis (right eye); a basal skull fracture; and fractured third, fourth, fifth, sixth and seventh left side ribs, with a left lung contusion and collapse. Due to the amount and extent of his injuries, our client, who was 46 years old at the time, was told he would never drive a tractor-trailer again. The matter resolved during Alternative Dispute Resolution (ADR) for $4,225,000.00 in under a year.
