We had the privilege of representing a husband and wife involved in a motor vehicle accident while vacationing in Maine. Their trip took a tragic turn when a drunk, uninsured driver crossed the center line and collided head-on with our client’s vehicle.
The husband, 75 at the time, sustained significant injuries. Just seven months before the accident, he had undergone a lumbar discectomy for an unrelated condition. After the crash, he initially sought care from a local chiropractor, who referred him back to the neurosurgeon who had performed his prior surgery. The neurosurgeon diagnosed him with acute cervical spine herniations caused by the collision, which risked severe nerve damage if left untreated. Six weeks later, he underwent a three-level cervical fusion surgery.
Despite the challenges of proving his cervical injuries were the fault of the crash, and not due to his pre-existing degenerative disc disease, we successfully settled his case for $375,000.
