On June 24, 2024, our clients, a husband and wife, were involved in a traumatic and life-changing accident on the Seneca Turnpike in New Hartford, New York. Our clients were on their way to a Parkinson’s support group meeting and were stopped at a red light when the other driver left the roadway, struck several curbs, and then landed partially on top of our client’s vehicle. The impact was so severe that the jaws of life were required to extricate our clients from the vehicle, and one of our clients had to be airlifted to a nearby hospital where it was determined that he suffered multiple fractures and internal bleeding. We were able to successfully obtain the full $100,000 policy on behalf of the husband within 30 days of the accident occurring, easing the family’s concerns about the medical bills that had already begun to pile up.
Our other client sustained a fractured tibia in the collision and the trauma from this accident significantly impacted her mental and emotional well-being. The insurance company initially offered $65,000, which was immediately rejected. After staying firm and negotiating for two months, we obtained a $95,000 offer which was accepted by the family.
In addition, this case involved complicated no-fault issues and due to their persistence with following up with all medical providers and dealing with the no-fault insurance company directly, Samantha’s legal team was able to successfully handle the no-fault claim such that neither client was required to pay any substantial liens out of their settlement, despite the significant cost of their treatment.
